Claire Cole (pictured), senior solicitor in Harper James’ employment team, has welcomed the UK Government’s new consultation on the Employment Rights Bill, which proposes a statutory right to bereavement leave for pregnancy loss before 24 weeks.
The consultation is set to run until 9th December 2025 and could mean new legal requirements for all employers, including small and medium-sized enterprises (SMEs).
Cole said: “The consultation on bereavement leave is a very welcome step towards recognising the reality of loss in the workplace.
“For the first time, the Government is proposing a statutory right to time off for pregnancy loss before 24 weeks, which would be a significant change for many employees and employers.
“For small and medium-sized businesses, this will mean taking a closer look at how bereavement is currently managed, and making sure that policies and day-to-day practices reflect both the new legal standards and a compassionate approach.”
Cole added: “While the proposal focuses on unpaid leave, it is ultimately about establishing a shared baseline of understanding and respect.
“Many employers already offer flexibility and support when employees experience a loss, but clearer statutory guidance can help make those conversations easier and more consistent.
“It will be important for managers to feel equipped to respond sensitively, maintain confidentiality, and support staff during what can be an extremely difficult time.”
She said: “Handled thoughtfully, these changes have the potential to create workplaces where people feel supported when life takes an unexpected turn, and where compassion sits alongside compliance.”
